Terms of Service

These Terms of Service ("Terms") govern your use of the MaliaFood platform operated by MALIDADDY Limited ("Company", "we", "us", or "our"), a company registered in Jamaica with its principal place of business at 14 Canberra Crescent, Kingston 6, Jamaica.

1. Definitions

  • "Platform" means the MaliaFood software-as-a-service application and related services.
  • "Merchant" means a restaurant, food establishment, or business that subscribes to use the Platform.
  • "Customer" means an end user who places orders through the Platform.
  • "Services" means the online ordering, menu management, and business tools provided through the Platform.

2. Platform Services

MaliaFood provides Merchants with:

  • Online ordering system for delivery, pickup, and dine-in orders
  • Menu and catalogue management tools
  • Order management and notification systems
  • Customer data management (subject to our Privacy Policy)
  • Reporting and analytics

3. Merchant Responsibilities

As a Merchant, you agree to:

  • Provide accurate menu information including prices, descriptions, and allergen information
  • Fulfill orders in a timely manner as represented to Customers
  • Comply with all applicable food safety and health regulations
  • Handle Customer data in accordance with applicable privacy laws
  • Maintain appropriate business licenses and permits
  • Respond to Customer inquiries and complaints professionally

4. Fees and Payment

Subscription fees, transaction fees, and payment terms are as agreed in your Merchant Agreement. We reserve the right to modify fees with 30 days notice.

5. Data and Privacy

Your use of the Platform is also governed by our Privacy Policy. You acknowledge that:

  • You are the data controller for Customer data collected through your use of the Platform
  • We act as a data processor on your behalf
  • You are responsible for obtaining appropriate consent from Customers
  • You will not use Customer data for purposes other than fulfilling orders and providing service

6. Intellectual Property

The Platform, including all software, designs, and content, is owned by MALIDADDY Limited. You retain ownership of your menu content, branding, and Customer relationships.

7. Limitation of Liability

To the maximum extent permitted by law, MALIDADDY Limited shall not be liable for:

  • Any indirect, incidental, or consequential damages
  • Loss of profits, data, or business opportunities
  • Actions or omissions of Customers or third parties
  • Service interruptions beyond our reasonable control

8. Termination

Either party may terminate this agreement with 30 days written notice. We may suspend or terminate your account immediately if you breach these Terms or engage in fraudulent activity.

9. Governing Law

These Terms are governed by the laws of Jamaica. Any disputes shall be resolved in the courts of Jamaica.
