Customer Terms of Use

These Customer Terms of Use ("Terms") govern your use of the MaliaFood ordering platform when placing orders with restaurants and food establishments ("Merchants"). The platform is operated by MALIDADDY Limited, registered in Jamaica at 14 Canberra Crescent, Kingston 6.
Important: When you place an order, you are entering into a direct transaction with the Merchant. MaliaFood provides the technology platform but is not a party to your order.
1. Using the Platform
By using MaliaFood to place orders, you agree to:
- Provide accurate contact and delivery information
- Be available to receive your order at the specified location
- Pay for orders you place
- Use the platform for personal, non-commercial purposes
- Not engage in fraudulent or abusive behavior
2. Orders and Payment
- Prices displayed include applicable taxes as shown by the Merchant
- Delivery fees and minimum order amounts are set by each Merchant
- Once an order is confirmed, it may not be cancelled without the Merchant's consent
- Payment is processed securely through our platform or collected by the Merchant
3. Delivery and Pickup
- Estimated delivery times are provided by Merchants and may vary
- You must be available at the delivery address to receive your order
- For pickup orders, you must collect your order at the specified time
- Uncollected orders may be disposed of and are non-refundable
4. Refunds and Complaints
Since your order is with the Merchant directly:
- Refund policies are determined by each Merchant
- Contact the Merchant directly for order issues
- MaliaFood may assist in facilitating communication but is not responsible for order fulfillment
- Report any platform issues to info+malia@malidaddy.com
5. Food Safety and Allergies
Allergen Warning: Menu items may contain allergens. If you have food allergies or dietary restrictions, please contact the Merchant directly before ordering.
- Merchants are responsible for food safety and accurate menu descriptions
- Allergen and nutritional information is provided by Merchants
- Always verify ingredients if you have allergies
6. Your Information
When you place an order, your information (name, phone, address) is shared with the Merchant to fulfill your order. See our Privacy Policy for details on how we handle your data.
7. Merchant Terms
Individual Merchants may have additional terms, policies, or disclaimers that apply to your order. These will be displayed on their ordering page when applicable.
8. Limitation of Liability
MaliaFood provides the ordering platform only. We are not liable for:
- Food quality, safety, or preparation
- Delivery delays or issues
- Merchant pricing or availability
- Any claims arising from your order with a Merchant
9. Account Suspension
We may suspend your access to the platform if you:
- Engage in fraudulent activity
- Abuse the platform or Merchants
- Repeatedly fail to collect or pay for orders
- Violate these Terms
10. Governing Law
These Terms are governed by the laws of Jamaica.
